She was passed over twice for the position, despite the fact that she had prior job experience and met all the criteria.
As the parties were heading toward the punitive damages phase of the trial, in which the jury could have awarded additional damages against the County, the County decided to settle Smith’s claims. As part of the settlement, the County agreed to pay for the damages awarded and for Smith’s legal fees and settled her case for $150,000.
